Who these terms are for

These Terms govern access to and use of KickBooker by businesses, sole traders, independent professionals and people acting in connection with their professional activity. The management portal is not intended for private consumer use. If you use KickBooker for an organisation, you confirm that you are authorised to act for it.

KickBooker is operated by Planesta s. r. o., company ID 57050376, with its registered office at Tomášikova 12573/50E, 831 04 Bratislava – Nové Mesto, Slovakia (Planesta). These Terms form the agreement between Planesta and the person or organisation using the platform professionally.

Pilot service

KickBooker is an evolving pilot and prototype. It supports business setup, spaces, activities, registrations, provider collaboration, payments and optional integrations, but individual features may be incomplete, experimental or unavailable. You must assess whether the service is suitable for your operation before relying on it.

Planesta may improve, replace, restrict or discontinue features and may change technical requirements. Access to a pilot feature does not promise that it will become permanent, remain free or be released in a particular form or on a particular date.

Accounts and authorised access

Provide accurate information, keep sign-in methods secure and use only accounts and businesses you are authorised to access. You are responsible for actions performed through your account unless they result from a security failure for which Planesta is legally responsible. Tell us promptly if you suspect unauthorised access.

Do not misuse the platform, evade access controls, interfere with other users, upload unlawful or harmful material, probe the service without permission or use it in a way that breaches law or third-party rights.

Service communications

By creating an account and accepting these Terms, you agree that Planesta may send operational emails needed or reasonably useful to provide KickBooker. These can include account and security notices, invitations, booking or payment events and one setup-help email if your self-service onboarding shows no progress for at least 72 hours. The setup-help email may ask for feedback and explain how to continue.

Service emails do not advertise paid services, investment or partnership offers and do not constitute consent to direct marketing. Marketing communication requires a separate lawful basis where applicable. How Planesta handles personal data is described in the Privacy Policy.

Free basics and paid work

The basic KickBooker product is currently available without a KickBooker subscription fee or platform commission. This is not a promise that the basic product, any feature or 0% commission will remain free or unchanged. Planesta will communicate material pricing terms before charging for a service that was not previously subject to that charge.

Extensions, custom development, integrations, data work, onboarding services and individual support are paid only under a separate written agreement. Stripe and other third parties may charge their own fees independently of Planesta.

Your operation and your clients

The business, organiser or independent provider remains responsible for its activities, descriptions, prices, capacity, availability, staff and providers, premises, permissions, taxes, client information and compliance with sector-specific rules. It must publish and honour its own booking, cancellation, refund, attendance and access rules and provide legally required information to clients.

KickBooker is a technical platform. Planesta is not the organiser, provider, landlord, employer, payment recipient or contracting party for an activity unless a separate written agreement expressly says otherwise. You are responsible for resolving claims concerning the service you provide and for using participant data lawfully.

Payments and third-party services

Online payments are processed through Stripe or another configured third-party provider under that provider’s terms. The responsible business or provider must connect and maintain the correct account, complete verification and check its payout, refund, tax and dispute settings. KickBooker may display payment status received from the provider but does not guarantee approval, settlement, payout timing or reversal outcomes.

Optional services such as Google, email delivery and door-access integrations remain subject to their operators’ availability and terms. Planesta is not responsible for a third party’s independent acts, outages, account restrictions or changes, but this does not limit responsibility that applicable law places on Planesta for its own conduct.

Availability, changes and backups

The pilot is provided on an as-available basis. Planesta does not promise uninterrupted operation, a particular uptime, error-free output, compatibility with every device or workflow, preservation of every optional integration or a specific business result. Maintenance, security work and circumstances outside reasonable control may interrupt access.

You should keep appropriate copies of information needed to run your operation and maintain a practical fallback for critical bookings, access and payments. Planesta will use reasonable care in operating the platform but cannot guarantee that transmission, storage or security will be risk-free.

Content and intellectual property

You retain rights in content and business information you submit. You grant Planesta a non-exclusive right to host, copy, process and display that material only as needed to operate, secure and improve KickBooker and fulfil these Terms. You confirm that you have the rights and permissions needed for material you upload or publish.

KickBooker, its software, design and brand remain the property of Planesta or its licensors. These Terms give you a limited, non-transferable right to use the service for your professional operation; they do not transfer ownership or permit copying, resale or creation of a competing service from protected parts of KickBooker.

Proportionate limitation of liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability arising from intentional misconduct or gross negligence where applicable. Subject to those mandatory rules, Planesta is liable only for direct, reasonably foreseeable loss caused by its breach of these Terms and is not liable for indirect loss, lost profit, lost opportunity, reputational harm or a third party’s failure.

To the extent permitted by law, Planesta’s total liability connected with KickBooker in any twelve-month period is limited to the higher of the fees you paid Planesta for the affected service during that period or EUR 100. This allocation reflects the pilot nature and free basic availability of the service. It does not reduce any remedy or protection that applicable mandatory law grants you.

Suspension and ending use

You may stop using KickBooker and request account closure, subject to records that must be kept for security, legal, booking or payment reasons. Before leaving, export or retain information you need. Closing an account does not by itself cancel obligations between an organiser and its clients or providers.

Planesta may restrict or suspend access when reasonably necessary for security, suspected abuse, unlawful use, serious or repeated breach, non-payment under a separate agreement or protection of other users. Where practical and safe, Planesta will give notice and an opportunity to remedy the issue.

Governing law and disputes

These Terms are governed by the laws of the Slovak Republic. Courts of the Slovak Republic have jurisdiction over disputes, unless mandatory law requires another forum. Before starting formal proceedings, the parties should try in good faith to resolve the issue through the contact address above.

If a mandatory rule applies regardless of this business-use agreement, that rule prevails to the extent of the conflict. No wording in these Terms removes rights that cannot legally be waived.

Changes and contact

Planesta may update these Terms as KickBooker, the pilot or applicable requirements develop. The current version and effective date are published on this page. If a change requires separate notice or renewed acceptance, Planesta will provide it before the change becomes binding as required.

Accounts created before the effective date above are not asked to accept this version again; continued professional use after publication is treated as agreement to these Terms. Accounts created on or after the effective date must accept them using the checkbox shown during onboarding or before portal access.

Questions about these Terms can be sent to info@planesta.sk. Separate paid work, service levels, data-processing commitments or special requirements apply only when agreed in writing by the relevant parties.
